He "can" if he does he's not all that honorable.
I do most of my PVP in the Arena zone, (this is a blast by the way, a whole
new way to have fun in the game...tired of camping for that rare loot? Go
to arena and beat some people down/get beat down.) You can bind in the zone
regardless of class, so downtime is very short (I usually have someone kill
me when I'm oom, so I don't have to waste time medding) There's no looting
and no xp loss, just fun :) Necros are a *very* powerful PVP class,
unfortunately you can't summon a pet in the arena (he kills himself
immediately) but even without him you can kick some ass. I beat down an
equal level enchanter, a magician, a wizard a shaman and a warrior that was
5 levels above me.

At level 34 I beat up a level 41 warrior. It's just a matter of
avoidance.
Shadowstep, darkness, shadowstep, dot, shadowstep, dot. It's tough
against
the higher level warriors, just because those bastards have so many
hitpoints :) I'd usually get all my DOT's set, shadowstep once more then
gather shadows and med ;) it's a mean and nasty strategy and they'll
bitch
to no end about you not fighting fair...but hey...if you can't use your
spells, they can't use their weapons and armor ;)
